Judge Drops Aggravated Assault Charge In Pregnant Woman Overdose Case

THE BABY WAS DELIVERED EARLY AND WILL LIKELY HAVE HEALTH STRUGGLES BUT A LOCAL JUDGE HAS THROWN OUT THE MOST SERIOUS CHARGE AGAINST HER. 30-YEAR-OLD KASEY DISCHMAN WAS CHARGED WITH FELONY AGGRAVATED ASSAULT OF AN UNBORN CHILD. POLICE SAY SHE WAS FOUND ON THE BATHROOM FLOOR OF HER APARTMENT OVERDOSED ON OPIATES. PARAMEDICS RUSHED HER TO THE HOSPITAL. THE NEXT DAY DOCTORS PERFORMED AN EMERGENCY C- SECTION. HER ATTORNEY ARGUES SHE IS PROTECTED FROM THE ASSAULT CHARGE BY A CLAUSE IN THE LAW EXEMPTING PREGNANT WOMEN FROM PROSECUTION FOR CRIMES AGAINST THEIR UNBORN CHILDREN. AS I INDICATED THIS IS A WOMEN. THERE ARE DRUG ADDICTED BABIES BORN EVERY DAY. DEPENDING ON THE RULING POLICE JUDGE WILLIAM SCHAEFER AGREED HE SAYS THAT WHILE THE DEFENDANT DID A SELFLESS — SELFISH HEINOUS ACT RESULTING IN PERMANENT INJURIES TO HER CHILD THIS COURT IS CONSTRAINED. THE JUDGE DISMISSED THE AGGRAVATED ASSAULT CHARGE BUT LESSER CHARGES OF CHILD ENDANGERMENT, CORRUPTION OF A MINOR AND DRUG POSSESSION WILL PROCEED. THIS CASE IS A TRAGEDY FOR EVERYBODY INVOLVED.
